My options when considering divorce

There are 3 types of divorce procedures which you and your spouse can choose from.

Uncontested Divorce

Contested divorce
Option 1: Uncontested Divorce

This is the most cost effective and quickest option which reduces the emotional and financial stress associated with divorce.

In this instance, the spouses work together to agree on the terms of their divorce.

Once they have decided on the major issues they then approach an attorney to draw up the relevant documents to be filed at Court.

These types of divorces can be resolved and finalized in a few weeks.

Some of the major aspects which need to be consider are:
The division of assets;
Maintenance;
How will the children be cared for?

Option 2: Mediated Divorces

This process involves the parties using a mediator to help them work constructively through difficult discussions to try and find a solution to the issues which need to be decided on when getting divorced.

The mediator is a neutral 3rd party who creates an environment conducive for negotiation and problem solving.

This process is ideal where the parties need to co-parent in the future.

This option can take a few months or a few weeks, it all depends on the parties and their willingness to move forward.

It is a cost effective and less stressful option.

Option 3: Contested Divorce

This is where the parties are unable to reach a settlement either together or with a mediator, and, in some cases struggle to even communicate with each other.

In this instance, the parties each choose their own attorney to fight for their rights through the courts.

It is an extremely costly experience which is emotionally traumatising.

This option can literally drag on for years.

The matter will eventually land up in the High Court where a Judge will decide on their affairs for them.
